Certain consumers who purchased an abdominal exercise device that was marketed deceptively will receive a partial refund, Federal Trade Commission says.
FTC will mail 196,969 refund checks to people who bought the Ab Circle Pro and submitted a refund claim to the agency. Each person will receive an average of $47.51. Consumers typically paid at least $200 for the product.
In August 2012, Fitness Brands, which is a company that marketed the Ab Circle Pro, as well as four individuals and seven other companies, agreed to pay the refunds to settle FTC charges. The $9.3 million in total refunds reflects the volume of refund requests that consumers submitted to FTC.
According to FTC, Fitness Brands claimed that consumers would lose 10 pounds in 2 weeks if they used the Ab Circle Pro for 3 minutes per day. The claims were made in TV infomercials that aired at least 10,000 times from March 2009 to May 2010.
FTC says checks must be cashed within 60 days of when they were issued. The deadline for filing a refund request has expired. Consumers who have questions should call 866/402-4752 or go to ftc.gov/refunds.
